1) I have a small software/apps company. Rough sketches and wireframes of the software/apps are compiled in the U.S. However, all the development is outsourced overseas to India. The software/apps are sold over the internet to customers all over the world. Other things such as domain, registrar, etc. Are all offshore.
For U.S. tax planning purposes, where is the “source” of income? Also, if the apps are sold via the IPhone/IPad app store instead of through a privately owned offshore hosted website, is this considered U.S. based income assuming Apple’s servers, and therefore payment processing, are in the U.S.? Or does that matter?
Would you structure the business offshore in order to lighten tax obligations (or possibly deferment)? Or would there even be a benefit to doing so given the above scenarios? Also, just to clarify, I do realize there may be advantages to incorporating offshore other than just tax issues.

2) I have a business that does internet marketing for local businesses located in the U.S. (i.e. Dentists, doctors, lawyers, etc.). How would the IRS view this income for tax purposes?

I guess I’m just trying find out if there’s a way to structure a service-based business (with the actual service “work” being done overseas) in order to gain tax benefits. For product-based businesses it seems pretty straightforward.”
Here’s my answer:
If the income is paid from Apple Inc in the USA, the income is US sourced. However that doesn’t really matter to answer your question. What does matter is tax residency.
If you are US tax resident, you’ll pay tax on it. However if you were Singapore tax resident, you wouldn’t have to pay tax on foreign sourced income, unless you were silly enough to bring that income into Singapore.
So one of the most common structures is a Singapore company with a Hong Kong bank account. Under this structure you pay tax only on the money that you actually earn (the company pays you and you bring back into the USA).
